Cookie

COOKIES
Cookies are small text files that are sent to the user´s terminal equipment by visited websites; they are stored in the user´s terminal equipment to be then re-transmitted to the websites on the user´s subsequent visits to those websites. When navigating a website, a user may happen to receive cookies from other websites (see the Provision of the Data Protection Authority May 8, 2014, n.229). In order to achieve the correct regulation of these devices, it is necessary to distinguish them according to the aims pursued by those who use them.

Technical Cookies.
Technical cookies are those used exclusively with a view to “carry out the transmission of a communication on an electronic communications network, or insofar as this is strictly necessary to the provider of an information society service that has been explicitly requested by the contracting party or user to provide the said service.” (see Section 122(1) of the Code and Provision 229/2014). They can be grouped into browsing or session cookies, which allow users to navigate and use a website (e.g. to purchase items online or authenticate themselves to access certain website areas). Users´ prior consent is not necessary to install these cookies.

Profiling Cookies.
Profiling cookies are aimed at creating user profiles. They are used to send ads messages in line with the preferences shown by the user during navigation. In the light of the highly invasive nature of these cookies, users’ prior consent is required to install them, as provided for by Section 122 of the Code.

Analytics Cookies.
Their task is to monitor how users utilize the web page by providing statistical reports that can support the publisher of the site in its optimization. One of the most used tools for web analytics is “Google Analytics”, a service of Google Inc. through which it is possible to collect web traffic statistics. The Data Protection Authority has clarified that these cookies can be equated to technical cookies insofar as IP addresses are anonymized (even partially) and information is not shared with Google. Otherwise these types of cookies are equated to profiling cookies. The company has proceeded to partly anonymize the users’ IP addresses and reduce the data that Google can access through the Analytics tools

Each type of cookie can be first-party (i.e. processed and managed directly by the owner of the website) or third-party (when installed and acquired by different subjects). Among the third-party cookies we find the so-called social plugins, which are the components that allow integration with social media companies that operate via the website (such as Facebook, Twitter, Google+, LinkedIn, Pinterest, Tumblr etc.), when these generate cookies. For the processing of information collected by third parties please refer to the relevant guidelines.
